Waiver Versus the Cort's Sus Sponte Recognition of a Cause of Action

By Jeffrey P. Lewis

Where a complaint alleges a count against a lawyer for “professional malpractice,” can it be characterized as a legal malpractice claim sounding in breach of contract instead of in tort, although the complaint does not state “breach of contract”?  May an appellate court sua sponte find that the complaint states a claim for breach of contract when the plaintiffs never argued before the trial court or the appellate court that their complaint states a claim for breach of contract?  The Supreme Court recently addressed these issues in Steiner v. Markel, ___ A.2d ___, 2009 WL 1143283 (Pa.).
